Open Source Freeware Software License Agreement

1. Definitions

"Software": The drm-cli software provided under this Agreement, including any updates, modifications, and any associated documentation.

"Licensor": d-band, the entity that owns the Software and is granting the license under this Agreement.

"Licensee": Any individual or entity who uses the Software under the terms of this Agreement.

"Open Source": Refers to software for which the source code is freely available for modification and distribution under the terms of this Agreement.

"Freeware": Refers to software that is provided free of charge.

2. Grant of License

d-band grants the Licensee a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable license to:

  • Use, copy, modify, and distribute the drm-cli Software, either in binary or source code form.
  • Create derivative works of the drm-cli Software.

3. Redistribution

Redistribution of the drm-cli Software, in either source or binary form, must comply with the following conditions:

  • The original copyright notice, this license agreement, and the disclaimer of warranties must be included in all copies or substantial portions of the Software.
  • If the drm-cli Software is modified, the resulting work must be marked as modified to avoid any confusion with the original Software.
  • If the drm-cli Software is modified and redistributed, the modified version must include the following statement:
    "This software has been modified by d-band or its contributors."
  • The Licensee must give appropriate credit to d-band, provide a link to the original drm-cli Software, and indicate if changes were made.

4. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • THE USE OF THE SOFTWARE IS AT THE USER'S SOLE RISK. D-BAND BEARS NO RESPONSIBILITY FOR ANY CONSEQUENCES ARISING FROM THE USE OR MISUSE OF THE SOFTWARE. IN NO EVENT SHALL D-BAND OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

5. Limitation of Liability

To the maximum extent permitted by law, in no event will d-band be liable for any damages arising out of the use or inability to use the drm-cli Software, even if d-band has been advised of the possibility of such damages.

6. Termination

This license is effective until terminated. The Licensee's rights under this license will terminate automatically without notice from d-band if the Licensee fails to comply with any term of this Agreement. Upon termination, the Licensee must destroy all copies of the drm-cli Software.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles.

8. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior or contemporaneous understandings regarding such subject matter.
