End User License Agreement (EULA) for UnixMC

IMPORTANT: READ CAREFULLY BEFORE USING THIS SOFTWARE

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and UnixMC for the UnixMC software product, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

  1. GRANT OF LICENSE: UnixMC grants you the following rights provided that you comply with all terms and conditions of this Agreement:

    a. Use: You may use the Software for personal, non-commercial purposes only.

    b. Installation: You may install the Software on a single computer; additional copies may only be installed for backup purposes.

  2. RESTRICTIONS:

    a. No Redistribution: You may not distribute copies of the Software to third parties.

    b. No Modification: You may not modify, adapt, translate, or create derivative works based on the Software.

    c. No Reverse Engineering: You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

    d. No Commercial Use: The Software may not be used for commercial purposes without obtaining a separate license from UnixMC.

  3. TERMINATION: Without prejudice to any other rights, UnixMC may terminate this Agreement if you fail to comply with the terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts.

  4. COPYRIGHT: The Software is protected by intellectual property laws and treaties. UnixMC or its suppliers own the title, copyright, and other intellectual property rights in the Software.

  5. LIMITED WARRANTY: The Software is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  6. LIMITATION OF LIABILITY: In no event shall UnixMC or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Software, even if UnixMC has been advised of the possibility of such damages.

  7. GOVERNING LAW: This Agreement shall be governed by the laws of the jurisdiction in which you reside.

ACKNOWLEDGMENT: BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU ALSO AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND UNIXMC AND SUPERSEDES ALL PROPOSALS OR PRIOR AGREEMENTS, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN YOU AND UNIXMC RELATING TO THE SOFTWARE.
