RemoteMedia SDK Community License 1.0

Copyright (c) 2026 Mathieu Gosbee

This license governs use of the RemoteMedia SDK source code, binaries, examples, documentation, models, configuration files, pipeline definitions, and related materials made available in this repository, unless a file or directory clearly states that it is governed by a different license.

RemoteMedia SDK is source-available software. It is not licensed as open source software.

1. Purpose

RemoteMedia SDK is made available so that individuals, researchers, students, small teams, startups, and small organizations can study, evaluate, modify, and use the software without needing a paid commercial agreement.

Larger commercial organizations, hosted-service operators, OEMs, redistributors, and companies embedding RemoteMedia SDK into commercial products must obtain a separate commercial license.

2. Definitions

"Software" means the RemoteMedia SDK source code, binaries, examples, documentation, manifests, pipeline definitions, tests, and related materials provided by the Licensor.

"Licensor" means Mathieu Gosbee, operating as the copyright holder of RemoteMedia SDK.

"You" means the individual or legal entity exercising rights under this license.

"Organization" means the company, institution, partnership, government body, non-profit, foundation, or other legal entity on whose behalf the Software is used.

"Revenue" means total gross revenue earned by an Organization and its affiliates from products, services, and operations during the most recently completed fiscal year, before expenses.

Investment funding, venture capital, loans, grants, donations, capital contributions, and similar non-operational sources of capital are not Revenue for purposes of this license.

"Affiliate" means any entity that controls, is controlled by, or is under common control with another entity.

"Production Use" means use of the Software in a deployed system, product, service, workflow, internal business process, customer-facing system, hosted service, embedded device, commercial demo, paid pilot, or operational environment.

"Hosted Service" means any network-accessible service, API, platform, agent, pipeline runtime, media-processing service, inference system, cloud service, developer tool, automation service, or managed service that uses the Software to provide value to third parties.

"Competing Service" means any product, hosted service, SDK, framework, runtime, platform, or commercial offering that:

(a) is the Software, a modified or derivative version of the Software, or a substantial portion of the Software, made available to third parties as a paid product or commercial service; or

(b) is substantially derived from the Software and provides the Software's core functionality — namely, real-time media pipeline orchestration, multi-runtime media processing, or media-pipeline SDK or runtime capabilities — as the primary value of the offering to third parties.

Building a product, application, or service that internally uses the Software to deliver end-user value (for example, a voice assistant, a transcription application, a customer service agent, an avatar product, a media-processing application, or any other end-user product or service) is not a Competing Service, even if such product, application, or service processes real-time audio, video, or other media. Such uses remain subject to the other terms of this license, including the Revenue threshold and Hosted Service provisions in Sections 3 and 4.

3. Free Community Use

Subject to this license, you may use, copy, study, modify, build, and run the Software without a paid commercial license only if all of the following are true:

  1. You are using the Software as an individual, or on behalf of an Organization whose Revenue is less than CAD $2,000,000 per year.

  2. You are not using the Software to provide a Competing Service.

  3. You are not offering the Software, a modified version of the Software, or a substantially similar hosted or managed service to third parties as a paid product or commercial service.

  4. You are not embedding the Software in a commercial hardware product, software product, SDK, cloud platform, developer platform, media platform, robotics platform, automotive system, telecommunications system, call-center system, surveillance system, or enterprise product.

  5. You are not redistributing the Software or modified versions of the Software as part of a paid product or commercial offering.

  6. Your use complies with all other terms of this license.

4. Uses Requiring a Commercial License

You must obtain a separate commercial license before using the Software if any of the following apply:

  1. Your Organization and its affiliates have Revenue equal to or greater than CAD $2,000,000 per year.

  2. You use the Software in Production Use for an Organization with Revenue equal to or greater than CAD $2,000,000 per year.

  3. You use the Software to provide, operate, sell, resell, host, or support a Hosted Service.

  4. You use the Software to build, operate, or support a Competing Service.

  5. You embed, bundle, distribute, or make the Software available as part of a commercial product, SDK, appliance, device, platform, cloud service, agent framework, model-serving system, media-processing system, robotics system, automotive system, or enterprise system.

  6. You use the Software to provide paid consulting, managed services, systems integration, implementation services, or outsourcing services for a third party, unless that third party is also permitted to use the Software under Section 3.

  7. You remove, obscure, or alter license notices, copyright notices, attribution notices, or source-availability notices.

5. Evaluation Use by Larger Organizations

Organizations with Revenue equal to or greater than CAD $2,000,000 may use the Software for internal evaluation for up to 30 calendar days without a commercial license, provided that:

  1. The Software is not used in Production Use.

  2. The Software is not used to provide a Hosted Service.

  3. The Software is not used to develop, test, benchmark, or improve a Competing Service.

  4. Access is limited to employees or contractors directly involved in evaluation.

  5. The Software is not redistributed outside the Organization.

After the 30-day evaluation period, continued use requires a commercial license.

6. Modification Rights

You may modify the Software for uses permitted by this license.

Modified versions remain subject to this license unless you have a separate written commercial license from the Licensor.

You may not use modifications to avoid the commercial-license requirements in Section 4.

7. Distribution Rights

You may distribute copies of the Software or modified versions of the Software only if:

  1. Your use is permitted under Section 3;

  2. Distribution is not part of a paid product, Hosted Service, Competing Service, OEM integration, enterprise platform, or commercial offering;

  3. You include this license with every copy;

  4. You preserve all copyright, license, and attribution notices; and

  5. You clearly identify any material modifications you made.

8. No Trademark Rights

This license does not grant permission to use the names "RemoteMedia", "RemoteMedia SDK", "Mathieu Gosbee", "matbee", associated logos, project names, domain names, or branding except as necessary for accurate attribution.

9. No Patent License Beyond Use of the Software

This license grants only the copyright permissions expressly stated above.

No patent license is granted except to the extent required to exercise the copyright permissions expressly granted by this license for permitted uses of the Software.

10. Contributions

By submitting a contribution to the Software, you grant the Licensor a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, sublicense, relicense, and otherwise exploit your contribution as part of the Software.

You represent that you have the right to submit the contribution and to grant these rights.

If you do not want to grant these rights, do not submit the contribution.

11. Third-Party Components

Third-party dependencies, libraries, assets, models, examples, or tools included with or used by the Software may be governed by their own licenses.

Those third-party licenses continue to apply. This license does not override third-party license terms.

12. Compliance

You must keep records reasonably sufficient to show compliance with this license.

Upon reasonable written request, you must confirm whether your use of the Software requires a commercial license.

If you exceed the permitted scope of this license, your rights under this license terminate automatically.

The Licensor may reinstate your rights if you stop the violation and make reasonable efforts to cure the breach.

13. Disclaimer of Warranty

The Software is provided "as is", without warranties or conditions of any kind, whether express, implied, statutory, or otherwise.

The Licensor disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, reliability, availability, accuracy, and performance.

14. Limitation of Liability

To the maximum extent permitted by law, the Licensor will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, loss of goodwill, or procurement of substitute goods or services arising from or related to the Software or this license.

The Licensor's total liability for all claims related to the Software or this license will not exceed CAD $100.

15. Governing Law

This license is governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-law rules.

Any dispute related to this license or the Software must be brought in the courts located in Toronto, Ontario, Canada.

16. Commercial License Supersedes This License

If you enter into a separate written commercial license with the Licensor, that commercial license controls to the extent it conflicts with this Community License.
